The District Court of Luxembourg hears cases at first instance for the capital district, while the court in Diekirch covers the north of the country and the justices of the peace in Luxembourg, Esch-sur-Alzette and Diekirch deal with everyday disputes. The legal & notarial sector in a country where three languages coexist
The Luxembourg District Court rules at first instance, and justices of the peace sit in Luxembourg, in Esch-sur-Alzette and in Diekirch. Around that structure, practice in this country demands a linguistic agility few bars ever meet: argument is heard in French, part of the documents filed arrive in German, commercial contracts are often drafted in English, and the parties themselves speak Portuguese, Italian, Serbian or Romanian. A single file therefore regularly puts three languages on the table, and nobody can do without the fourth.
Then comes the cross-border dimension. An employee living in Thionville or Trier and working in Hollerich, a foreign-law company owning a building in Bertrange, a divorce between spouses neither of whom was born here: each configuration pulls outside rules into the reasoning. Our rule is to render the procedural function of a term rather than its label, and to add a short note where the notion has no twin in the receiving system. A word carried across unchanged but wrongly placed costs more than a word explained.
Every document intended for a court or an authority is signed by a sworn translator listed by the Ministry of Justice, with their stamp and statement of conformity. Should the receiving authority also require that signature to be legalised, we handle it and the quote prices the extra time. The apostille follows a different logic: it bears on the original record, is requested from the Ministry of Foreign and European Affairs for a Luxembourg document and from the issuing state for one from elsewhere, and that step belongs to you. Can a ruling handed down abroad be used here as it stands?
The ruling travels, its translation does not. Produced before a Luxembourg court, it comes with a version prepared by a translator sworn and entered on the roll kept by the Ministry of Justice, stamp and statement of conformity included. We keep your exhibit numbering, so that lodging the file calls for no reshuffling.
Which language should the exhibits be filed in?
That depends on the court seised and on the intended use. Luxembourgish, French and German are the three languages admitted under the country's language regime, and a single file sometimes mixes the latter two. Tell us which language the case is being run in: we align the exhibits on that one rather than translating them twice.
How do you keep a large file on schedule?
The starting point is the date set by the judge, not our workload. Below roughly 2,000 words per working day a single translator is enough. Above that, the team splits the volume around a glossary kept in common, and a final read passes over the whole set so the terminology does not shift from one volume to the next.
An estate spread across several countries: where do we start?
With the list the notary gave you, not with the whole file. It rarely runs beyond five or six items: death, civil status of the heirs, any will, title deeds. We go through it with you, mark what has to be sworn, and everything else goes as a standard translation, which lightens the invoice accordingly.
