What the property & construction sector sends us most often

The market is tight and the clientele largely expatriate: managers here for a few years, families attached to the European institutions, employees of the financial centre, and cross-border workers who end up buying on the far side of one of the three borders. Many leases are negotiated in English while the notarial deed is drawn up in French or in German. Every document the buyer or the tenant did not understand comes back later as a complaint.

The property & construction sector in a country where three languages coexist

The country's property market feeds on constant arrivals: executives posted for a few years, officials of the European institutions, staff of the financial centre, long-settled families, and a cross-border clientele that looks over the line when prices climb. The upshot is that a lease is very often signed between two people who do not share a mother tongue, and an owners' meeting sometimes runs in three languages around one table.

The paper trail is long and we cover it end to end: lease and addenda, co-ownership rules, meeting minutes, sale deed, title deed, land registry extract, energy performance certificate, building permit. Districts under transformation bring their own vocabulary, from Kirchberg to the reclaimed grounds of Belval, and the planning rules there read with terms nobody improvises. When a document has to travel abroad, a title deed or a valuation for instance, the sworn version exists, with the signature legalised if the receiving authority insists.

A signature or a joint inventory of fixtures is decided within the hour. An interpreter in the room stops the misunderstanding from coming back two years later as a registered letter nobody wanted to write.

Misunderstandings always lodge in the same places: the day of signature, the joint reading of an inventory, the vote on works at a general meeting.

Signing at the notary office

A party present who cannot read the language of the deed needs the whole of it rendered out loud during the reading, for a sale as much as for a mortgage loan.

Joint inventory of fixtures

Record taken on moving in or moving out: what is not written down that day gets argued about a year later, with no witness.

Co-owners' general meeting

A sitting where some of the co-owners live outside the country: works to vote on, charges to explain.

Site meeting

Following the works and accepting them with a contractor whose crews come from another country.

A buyer trained elsewhere reads a preliminary agreement with the reflexes of their home country, and those do not transfer. The commitment takes effect on signature, time limits start running, and the technical annexes carry consequences that can be costed. Better to translate those papers before signature than after: the surprises hide in the annexes, rarely in the body of the deed.

A notarial deed calls for a sworn interpreter. Their registration is checked the day the date is held: a last-minute check leaves no room to move if the person turns out to be unavailable.

Frequently asked questions

Who books the interpreter, the notary office or the buyer?

Either, as long as the request comes in early. We need the date, the address of the appointment and the language of the party attending, nothing more. Allow twenty-four hours to line someone up on a common pair, longer on a rare language.

Is the sworn version of any use for a tenancy agreement?

Nothing requires it. The value lies elsewhere: a tenant given the lease and the building rules in a language they can read will no longer be able to plead a misunderstanding, whether the argument is about notice or about the service charge statement. A standard translation does the job. Sworn form only becomes useful if the document has to be produced before a judge.

Do you work for managing agents?

Yes. The constraint is the deadline for sending out the notices of meeting: everything that goes with them, agenda, draft budget, accounts for the year, has to be translated first. An interpreter can also attend the sitting. Some agents stop at the translated minutes, and that already puts an end to most complaints.

Do you translate the papers for a loan taken out abroad?

Regularly, in both directions: loan offer, amortisation table, mortgage mandate, insurance certificates. Those papers go to a financial translator, because a payment frequency, a rate or an early repayment clause rendered badly turns up later in a dispute.
